Unlike in countries where a notary handles most of a property transfer, Brazil separates notarial services from property registration. Two institutions matter most: the Cartório de Notas, which formalises certain legal acts, and the Cartório de Registro de Imóveis, which maintains the official property register and records changes in ownership.

The split has practical consequences for you as a buyer. Signing a purchase agreement or executing a public deed does not mean ownership has passed to you. The legal requirements must be met, and the transfer takes effect through registration with the competent property registry. This guide explains how the two institutions work, how they differ and what international buyers need to know.

What Is a Cartório in Brazil?

A cartório is an authorised office responsible for specific public notarial or registration services. These offices operate within a regulated legal framework, and each type has its own responsibilities. The term does not refer to one institution that handles every legal formality. Brazil has cartórios for notarial acts, property registration, civil records and the registration of legal entities and documents. Two are relevant when you buy property.

Cartório de Notas. Also known as Tabelionato de Notas, this office handles notarial acts, including public deeds (escrituras públicas) and public powers of attorney.

Cartório de Registro de Imóveis. This office maintains the official property records for its jurisdiction and registers ownership transfers, mortgages and other registrable rights affecting real estate.

The two can work together during a transaction, but they perform different legal functions. Take an apartment in Rio de Janeiro. Depending on the transaction, you and the seller may need to execute a public deed at a Cartório de Notas. That deed then goes to the competent Cartório de Registro de Imóveis, which records the transaction in the property’s official registration record, the matrícula do imóvel. Under the general rule in Brazilian law, ownership of real estate transfers through registration of the relevant title in this registry. The deed does not replace that registration, so signing it is not the final step of your acquisition.ich steps remain before the acquisition is legally complete.

Cartório de Notas: Notarial Services

The Cartório de Notas formalises certain legal acts and authenticates documents and signatures. In a property purchase, its most important task is usually preparing and executing the public deed. The notary (tabelião) is a public official who makes sure notarial acts meet the legal requirements: verifying identities, checking the parties’ legal capacity and putting their declarations of intent into the required form.

Public deeds. For many property purchases a public deed is required when the transaction exceeds the statutory threshold and no legal exception applies. The deed records the agreement between buyer and seller, including the property details, the purchase price and other relevant terms. Not every transaction needs one. Depending on the legislation and the structure of the deal, a private instrument can serve as the registrable title, for example in certain transactions involving financing. Even when a public deed is required, signing it does not complete the transfer. It goes to the competent Cartório de Registro de Imóveis for registration.

Powers of attorney. A public power of attorney (procuração pública) lets someone act on your behalf within the powers set out in the document. That helps international buyers who cannot attend every stage of the purchase in person: depending on the circumstances, a representative can sign documents, complete administrative formalities or carry out specified actions. The wording matters. The power of attorney must define the authorised actions clearly and meet the requirements of the institution or transaction it is meant for.

Signature recognition. The cartório also provides reconhecimento de firma, which verifies a signature according to the applicable procedure. Depending on the type of verification, the notary compares the signature with a specimen on file or confirms that it was made in the notary’s presence. This is not a legal review of a contract. Verifying a signature does not establish that a document’s contents are legally valid or that the person signing owns the property in question.

The Cartório de Notas formalises the relevant legal documents, but it does not replace the due diligence you need to verify ownership, identify restrictions and assess the legal status of the property.

Cartório de Registro de Imóveis: Property Registration

The Cartório de Registro de Imóveis maintains the official property records within its jurisdiction. It establishes and documents ownership and registers the rights and restrictions that Brazilian law recognises for real estate. Where the Cartório de Notas formalises legal acts, the property registry records the legal status of the property and registers documents that qualify for registration.

The matrícula do imóvel. Every registered property has its own registration record, which identifies the property and contains its legal history. Depending on the property, the record includes its identifying characteristics and registered area, the registered owner or owners, previous ownership transfers, registered mortgages and other encumbrances, and certain restrictions, court orders or other registered legal matters. Reviewing the matrícula is an essential part of due diligence, because it shows who is registered as the owner and whether registered rights or restrictions affect the acquisition. Do not rely on this one document alone. Depending on the property, you may need additional certificates, municipal records, condominium information or legal checks.

Registering the transfer. The process starts when the public deed, or another legally acceptable transfer instrument, is submitted to the registry. The registrar examines the document to see whether it satisfies the legal requirements. If it does, the transfer is registered in the matrícula. If the registrar finds deficiencies, the registry can require corrections before registration proceeds. You may have signed the purchase agreement and completed the deed, but the acquisition is not concluded until the registration has taken place.

Mortgages, restrictions and other registered rights. The registry also records mortgages, easements and other registrable interests. Before you buy, establish whether such entries exist and what they mean for you. Some are compatible with your purchase, while others require settlement, formal cancellation or further legal assessment, depending on the nature of the entry and the terms of the transaction. A registered mortgage does not simply disappear when the purchase price is paid.

The registry is the official record against which ownership and registered rights are assessed, which makes it fundamental to a secure acquisition. Review the property’s registration before you commit to the purchase, and after completion confirm that the transfer has been registered.ontract or public deed is not a substitute for completing the required property registration.

How Property Transfers Work in Brazil

The exact procedure depends on the transaction, but the line between executing the purchase documents and registering the transfer always applies. A conventional purchase runs through six steps.

Step 1: Verify the property’s legal status. Before you commit, obtain and review a current matrícula do imóvel from the competent Cartório de Registro de Imóveis. Do not work from an extract supplied at an earlier stage, because the record can change after it is issued. Check the registered owner, the property description and any registered mortgages, restrictions or other encumbrances. Further checks may be needed to find outstanding property taxes, condominium debts, planning issues or discrepancies between the registered property and its actual condition. These checks bring problems to light before the transaction progresses.

Step 2: Agree on the purchase terms. You and the seller agree on the price, the payment arrangements, the completion conditions and other relevant terms. These are normally documented in a purchase agreement (contrato de compra e venda or compromisso de compra e venda). A private purchase agreement creates contractual obligations between the parties but does not necessarily transfer ownership. The legal effect depends on the document, the transaction and the applicable legislation.

Step 3: Execute the public deed where required. Where the law requires a public deed, you execute it at a Cartório de Notas. The notary verifies the parties’ identities and formalises the transaction according to the requirements. Not every transaction needs a public deed: certain financing arrangements and other legally recognised situations allow a different instrument to serve as the registrable title. Before you sign, check that the deed reflects the agreed terms and the property’s identifying details accurately.

Step 4: Pay the applicable transaction taxes and fees. The purchase involves the municipal property transfer tax, ITBI (Imposto sobre a Transmissão de Bens Imóveis), as well as registration and notarial fees. The amount of ITBI depends on the municipality and its tax rules, and notarial and registration fees vary with the state fee schedule and the transaction. Establish which costs apply and when payment is due. Proof of payment may be needed before the registry can complete the transfer.

Step 5: Register the transfer of ownership. The public deed or other acceptable instrument goes to the competent Cartório de Registro de Imóveis. The registrar examines it and can require corrections or additional documentation if there are legal or formal deficiencies. Once the requirements are met, the transfer is registered in the matrícula do imóvel. This is the decisive step: under the general rule in Brazilian law, ownership transfers through registration of the relevant title. Plan it from the start, because errors, missing documents or unresolved issues delay completion, and confirm who submits the documents and follows up with the registry.

Step 6: Confirm the registration. After registration, obtain an updated copy of the matrícula do imóvel and check that the new ownership is recorded correctly. Keep the registered documents, the proof of tax payments and the purchase records. You may need them for future transactions, property management or administrative procedures.

What Foreign Buyers Need to Know

Foreign nationals can purchase urban real estate in Brazil without becoming Brazilian residents. The process does come with documentation and administrative requirements that you should settle before signing the final documents. The precise requirements depend on your nationality, whether you are physically present in Brazil, the type of property and the structure of the transaction.

Obtaining a CPF. The Cadastro de Pessoas Físicas (CPF) is Brazil’s individual taxpayer identification number, and foreign buyers usually need one to complete a property acquisition and deal with related tax and administrative requirements. A CPF does not make you a Brazilian tax resident or give you immigration status. It is an identification requirement used across financial and legal transactions. Arrange it early, so it does not delay the signing of documents or the transfer of funds.

Buying from abroad. You do not necessarily need to be in Brazil for every stage of the acquisition. Depending on the transaction, a representative can act for you under a valid power of attorney. The document must grant the necessary authority and meet the requirements of the institutions involved. If it is executed abroad, it can require an apostille or legalisation, a sworn translation into Portuguese, registration where applicable and other formalities, depending on where it was issued and how it will be used. Confirm these requirements before you sign. An incorrectly prepared power of attorney delays the transaction or stops your representative from carrying out the intended actions.

Do not expect your home-country notary. The Cartório de Notas does not provide the same services or carry the same responsibilities as a notary where you live. The notary formalises the legal act, the property registry records the transfer of ownership and other registrable rights, and neither replaces your own due diligence. A public deed does not remove the need to investigate the legal status of the property, check for debts or restrictions and confirm that the transaction is properly registered.

Check the documents before you sign. Make sure the property details, the purchase price, the payment arrangements and the identities of the parties match across all the relevant records. Depending on the circumstances, you will need some or all of the following:

Identification documents and CPF details.

The property’s current matrícula do imóvel.

Tax and condominium documentation.

Corporate documents if a company is buying the property.

A valid power of attorney if a representative signs for you.

Sworn translations or other formalities for foreign documents, where required.

Confirm the applicable documentation with the notary, the property registry and your legal adviser. Preparation is what prevents avoidable delays: get your identification in order, check documents early and understand the difference between notarisation and property registration.

How We Help

Buying property in Brazil involves legal and administrative steps from reviewing the documentation to completing the transfer of ownership.
